In many product liability cases, it's not enough to show that our client was injured as a result of using a given product. We also need to prove that the dangers involved with the product were unreasonable, and reflected negligence in the design or manufacturing process, improper refusal to design safety features into the product, or a negligent failure to warn of certain hazards in the ordinary use of the product.
In order to carry our burden of proof, we work intensively with industrial and design engineers to show how particular features of the product presented unreasonable dangers, and that effective safeguards could have been engineered into the product at a reasonable cost. Once in a while we even find evidence suggesting that the manufacturer considered and rejected safety features for the sake of profit margins.
The following are examples of the kinds of product liability cases we accept in Texas and Louisiana:
- Auto defects cases involving airbags, seat belts, brakes, tires, fuel systems or doors
- SUV or passenger van rollover cases involving roof crush injuries or fatalities
- Injuries caused by dangerous or defective industrial products
- Unsafe or defective components or equipment in commercial vessels or recreational boats and watercraft
- Dangerous household or consumer goods resulting in serious or fatal injury
- Dangerous or defective pharmaceuticals and medical devices
Because product liability litigation often requires the plaintiff to present highly technical evidence about engineering and production processes, a products defects lawsuit can be expensive and time-consuming. At Bernard & Hart, we take a selective approach to products litigation, but once we accept a case we advance all of the costs of proving your claims, and we only recover our costs if we make a successful recovery on your claims.
